ACORN. Not just Nuts, Nuts with Federal Funds

Federal funding:

In a written statement made by Bertha Lewis,  ACORN’s chief organizer claims the following:

” I am appalled and angry; I cannot and I will not defend the actions of the workers depicted in the video, who have since been terminated. It is clear that the videos are doctored, edited, and in no way the result of the fabricated story being portrayed by conservative activist ‘filmmaker’ O’Keefe and his partner in crime. And, in fact, a crime it was — our lawyers believe a felony — and we will be taking legal action against Fox and their co-conspirators,” she said.

I have a couple of questions for Bertha:  You fired four employees over “doctored video”?  That doesn’t sound very fair, or legal.  Are you then expecting to be sued for wrongful termination by the people you fired?  You say that technically, no law was broken…that may be true as no papers were signed and no one shook hands on a deal however, please explain the following activities witnessed and video taped in two of your offices:

  • How to start up their dream whorehouse with 13-year-old girls imported from El Salvador.
  • How to fly their house of ill repute under the radar as a “performing arts” center because the girls “are performing” and it is “a form of art.” Wink, wink.
  • How to avoid paying any taxes on the revenue generated by their ‘clients’.
  • How to fraudulently claim the underage illegal alien hookers as dependants on their year-end taxes.
  • How to funnel portions of their prostitutes hard earned dollars into congressional campaign coffers.

Now, I’m no law expert- clearly, but all of this “how to” business seems somewhat illegal on one level or another doesn’t it?  Maybe something along the lines of “conspiracy to commit” or “aiding and abetting”…let’s get some legal opinions on the matter, shall we?

2 ACORN Employees Fired, Could Face Criminal Charges
(Yes, it’s FOX news, but since ABC, NBC, CBS, CNN and other mainstream news affiliates seem intent on ignoring this topic, FOX and BigGovernment.com are all we’ve got at the moment, get over it)

Though no tax forms were filed and the child prostitutes didn’t exist, at least one ACORN official engaged in “numerous acts of criminal facilitation,” said Judge Andrew Napolitano, FOX News senior judicial analyst.

“Criminal facilitation occurs whenever a person encourages, enables, entices, or explains to another how to commit crimes with the real purpose of helping that person to commit those crimes” — a violation the ACORN employee “committed in full,” he said.

Napolitano said the worker could also face charges for criminal conspiracy, though each charge would require a heavier burden to prove: a so-called “act of furtherance” — a concrete move that makes the conspiracy active.

Napolitano outlined eight crimes the ACORN worker could potentially have committed that could bring a total sentence of 24 years in prison, including criminal facilitation and conspiracy to:

  • (a) commit prostitution
  • (b) operate a prostitution ring
  • (c) file false documents with taxing and other government authorities
  • (d) file false documents with a bank [also known as bank fraud]
  • (e) violate numerous immigration laws
  • (f) transport children into the U.S. for immoral purposes
  • (g) transport women into the U.S. for immoral purposes [also known as violating the Mann Act]
  • (h) impair the welfare of minors

But not all legal experts agreed that ACORN had committed a crime. Trial attorney Lee Armstong said that the employee had engaged in “repulsive … disgusting behavior,” but nothing illegal occurred because the entire scenario was a sham.

“For aiding and abetting tax evasion, for aiding and abetting child prostitution … you need the actual crime,” said Armstrong, an attorney for Jones Day in New York. “That’s what’s missing here.”

Armstrong said that the videotape appeared to show the ACORN official hatching a conspiracy, but no violation occurred because the 25-year-old filmmaker was only “pretending” to be a 25-year-old pimp.

“You need an actual agreement between two people to commit a crime. If one person is just faking it, you don’t have a meeting of the minds, you don’t have a conspiracy,” Armstrong told FOX News. “How do you clap with one hand?”

Okay, I can accept that perhaps no “actual crime” was committed.  I’d like to point out the obvious here and say that while O’Keefe and Giles WERE CERTAINLY pretending, the ACORN representatives WERE NOT! Could papers have been signed?  Could deals have been struck?  Circumstantial and irrelevant.  The road they were heading down though…extremely revealing.

However, I find it more than a little disturbing that Bertha Lewis’ main response to this incidious scandal is to deflect.  ACORN cries; Racism!, Illegal recording!, We’ll sue FOX!, We’ll sue O’Keefe and Giles! (PSSST!  Bertha! you might want to take a look at Maryland statute 10-402, Sections c,2,ii,1- B,D,E,I, & O first!)

O’Keefe says, “Bring it on!” THAT’s a campaign I could fund with a clear conscience!

So, how about it Bertha?  You contend the videos are “doctored”?  If so, why did you fire your employees over something they had no control of? Or, are you just pissed off that your organization has been caught red handed? Again. And again.   And again.  And a little bit more (Boy, I bet this gets old).  BTW, what do you know about meta-tags, Bertha?
